nicole smith daughter Anna Nicole Smith's daughter Dannielynn granted up to $49M in sanctions

Anna Nicole Smith‘s daughter Dannielynn Birkhead will soon be coming into a good deal of cash. U.S. District Judge David O. Carter has determined that Dannielynn will be rewarded up to $49 million in sanctions from the estate of J. Howard Marshall’s son E. Pierce Marshall.

Smith’s estate spent the past decade trying to recover hundreds of millions of dollars from her late husband Marshall’s estate, and Carter finally put that quest to rest. However, he did determine that Pierce would have to pay unspecified sanctions for using delaying tactics to make sure Smith’s lawyers couldn’t get their hands on crucial legal documents. Pierce passed away in 2006.

“Pierce’s bad faith conduct was too pervasive and too egregious to be ignored, despite the fact that he has since passed away,” Carter’s decision reads. “It would promote disrespect for the authority of the federal courts to turn a blind eye to actions that so willfully and blatantly attempted to make a mockery of this justice system. Further, it would reward a party for win-at-all-costs tactics, to the deprivation of his opponent. Such behavior cannot be condoned.”

Smith’s estate’s lawyer Phil Boesch tells Forbes that he believes Dannielynn will get the money she returns when her lawyers and Smith’s estate request sanctions on Aug. 13.

“This is a complete vindication of Anna Nicole’s rights and a total condemnation of what was done to her,” Boesch says. “We are confident that the amount Anna’s estate and daughter Dannilynn will finally be awarded will be fair and substantial.”
