Tracy Morgan is suing Wal-Mart over the fatal truck crash that hospitalized the “30 Rock” actor and others, in addition to killing Morgan’s friend, James McNair.

According to the lawsuit, quoted by The Hollywood Reporter, Wal-Mart was “negligent and careless” in policies that led directly to the June 7 crash on the New Jersey Tunrpike. Truck driver Kevin Roper has already been arrested on criminal charges of death and assault by auto.

“Wal-Mart was careless and negligent in the ownership and operation of its motor vehicle, which caused Mr. Morgan to suffer severe personal injuries,” the lawsuit reads. “As a direct and proximate result of said collision, Mr. Morgan was caused to sustain severe painful bodily injuries, including but not limited to multiple fractures which required multiple surgeries, extensive medical treatment and will require significant physical rehabilitation.”

Immediately after the accident, Morgan was listed as being in critical condition. He has since been moved to a rehab facility. McNair, the only fatality, was pronounced dead at the scene of the accident. Two others injured when Roper’s truck struck Morgan’s limo — Jeffrey Millea and Ardie Fuqua — as well as McNair’s widow, Krista Millea, are listed as co-plaintiffs in the complaint.

Why exactly was Wal-Mart at fault? The suit alleges that the company’s requirement that Roper drive excessive distances — a direct cause of his exhaustion — brought about the crash. The driver had been “awake for more than 24 consecutive hours,” having commuted 700 miles to begin his shift in Delaware. Wal-Mart allegedly has a record of ignoring such extreme working conditions.

Morgan and the others are seeking compensatory, statutory and punitive damages, in addition to fees.
