This week, a judge in a mental health court in Los Angeles ruled that the former “She’s All That” star is competent to stand trial for her DUI charges. The judge says that Bynes is capable of understanding the criminal charges brought against her, which stem from her April 2012 DUI where she hit a parked police car.

Bynes’ next court date is set for Jan. 7, 2014.

On Aug. 9, Bynes’ mother Lynn was granted a temporary conservatorship over her daughter, but eventually relinquished that in order for her doctors to determine the best course of action.

It sounds as though the former Nickelodeon star will enter rehab between now and the January court date and isn’t intending on living with her parents post-rehab.

A source tells Life & Style, “The next step for her will be to have a sober companion or coach. She’s not
leaving the facility on her own — she’ll still have someone with her.”

small step, but an incredibly important one. She now understands that
she needs to take her medicine daily. She has her good days and bad days
like everyone else, but she wants to move forward with her life — and
she is. She’s very stable.”
