The admission that cost Paula Deen her career isn’t even going to stand up in court. A judge threw out the race discrimination claims in the lawsuit Lisa Jackson leveled against Deen and her brother Bubba Hiers, though the sexual harassment claims still stand.

U.S. District Court Judge William T. Moore Jr. ruled on Aug. 12 that Jackson has no basis on which to sue Deen and Hiers for racial discrimination. She claims she had to deal with Deen and Hiers’ racist beliefs and sexual harassment during the five years she worked at Uncle Bubba’s Seafood and Oyster House. It’s worth noting Jackson is white.

Though Deen isn’t being taken to court over the racism claims, her admission of using the N-word during a deposition on the case led her to lose her Food Network job and a score of other endorsers.
